class=\"section-title-main\" >Via Sicura<\/span><b aria-hidden=\"true\"><\/b><\/h2><\/div>\n\n<p><strong>Via sicura<\/strong> consiste en un ensemble de modifications l\u00e9gislatives dont le but est l\u2019am\u00e9lioration du trafic et des contr\u00f4les routiers gr\u00e2ce \u00e0 de nouvelles dispositions.<\/p>\n<p>Dans ce cadre, Via sicura a notamment permis d\u2019instaurer le \u00ab&nbsp;<em>d\u00e9lit de chauffard<\/em>&nbsp;\u00bb qui punit les conducteurs d\u2019une peine privative de libert\u00e9 d\u2019un an au moins et entraine le retrait de permis de conduire lorsque des infractions jug\u00e9es graves sont commises, notamment des exc\u00e8s de vitesse.<\/p>\n<p>La derni\u00e8re mesure importante \u00e0 \u00eatre entr\u00e9e en vigueur est sans doute la force probante des \u00e9thylom\u00e8tres. En effet, d\u00e9sormais en cas de contr\u00f4le \u00e0 l\u2019\u00e9thylom\u00e8tre, une prise de sang n\u2019est plus n\u00e9cessaire si le conducteur reconna\u00eet le contr\u00f4le en signant le document qui atteste le taux relev\u00e9. Malgr\u00e9 des r\u00e9sultats positifs, ces mesures ont \u00e9t\u00e9 vivement critiqu\u00e9es, le Conseil f\u00e9d\u00e9ral proposant de renoncer \u00e0 certaines d\u2019entre elles, notamment par la r\u00e9duction du plancher des peines privatives de libert\u00e9 en cas de \u00ab&nbsp;<em>d\u00e9lit de chauffard<\/em>&nbsp;\u00bb passant d\u2019un an \u00e0 six mois.<\/p>\n<p>S\u2019agissant des<strong> jeunes conducteurs,<\/strong> un ensemble de mesures est d\u00e9sormais en vigueur. Les jeunes conducteurs sont soumis au \u00ab&nbsp;z\u00e9ro pour mille&nbsp;\u00bb pendant la p\u00e9riode de trois ans du permis \u00e0 l\u2019essai. Ainsi, si un taux d\u2019alcool\u00e9mie de plus de 0,1 \u2030 est constat\u00e9 chez le jeune conducteur titulaire du permis \u00e0 l\u2019essai, un retrait pr\u00e9ventif est effectu\u00e9 et la p\u00e9riode probatoire est prolong\u00e9e d\u2019une ann\u00e9e, passant de trois \u00e0 quatre ans. Cela vaut lors de la premi\u00e8re infraction. Lors d\u2019une seconde infraction, le permis devient tout simplement caduc.<\/p>\n<p>De plus, depuis le 1<sup>er<\/sup> janvier 2020, les jeunes conducteurs doivent, dans l\u2019ann\u00e9e qui suit la d\u00e9livrance du permis de conduire \u00e0 l\u2019essai, suivre une journ\u00e9e de formation compl\u00e9mentaire (et non plus deux journ\u00e9es). Cette journ\u00e9e permet aux jeunes conducteurs d\u2019assimiler les premi\u00e8res exp\u00e9riences pass\u00e9es en tant que conducteur et d\u2019\u00e9valuer leur propre comportement dans la circulation routi\u00e8re.<\/p>\n<p>Il est \u00e0 noter que, pass\u00e9 le d\u00e9lai d\u2019un an, le jeune conducteur qui n\u2019a pas effectu\u00e9 cette journ\u00e9e de formation risque une amende de CHF 300.-. En outre, si le jeune conducteur n\u2019effectue pas cette journ\u00e9e dans la p\u00e9riode probatoire de trois ans, son permis devient caduc et il devra tout recommencer.<\/p>\n<span class=\"scroll-to\" data-label=\"Scroll to: #permis-essai-limitations\" data-bullet=\"true\" data-link=\"#permis-essai-limitations\" data-title=\"Permis \u00e0 l&#039;essai, limitations\"><a name=\"permis-essai-limitations\"><\/a><\/span>\n\n<div class=\"container section-title-container\" ><h2 class=\"section-title section-title-normal\"><b aria-hidden=\"true\"><\/b><span class=\"section-title-main\" >What are the limitations of a trial license?<\/span><b aria-hidden=\"true\"><\/b><\/h2><\/div>\n\n<p>Les titulaires de permis \u00e0 l\u2019essai sont soumis \u00e0 <strong>une p\u00e9riode probatoire de trois ans<\/strong> avant la d\u00e9livrance du permis d\u00e9finitif, ce pour autant que les conditions d\u2019octroi soient remplies.<\/p>\n<p>Il faudra ainsi <strong>avoir suivi la journ\u00e9e de formation et ne pas avoir commis d\u2019infraction susceptible d\u2019entra\u00eener le retrait du permis<\/strong>, sous peine de voir la p\u00e9riode probatoire repouss\u00e9e d\u2019une ann\u00e9e, voire m\u00eame l\u2019annulation du permis \u00e0 l\u2019essai.<\/p>\n<span class=\"scroll-to\" data-label=\"Scroll to: #retrait-permis-essai\" data-bullet=\"true\" data-link=\"#retrait-permis-essai\" data-title=\"Retrait du permis \u00e0 l&#039;essai\"><a name=\"retrait-permis-essai\"><\/a><\/span>\n\n<div class=\"container section-title-container\" ><h2 class=\"section-title section-title-normal\"><b aria-hidden=\"true\"><\/b><span class=\"section-title-main\" >Withdrawal of licence on probation<\/span><b aria-hidden=\"true\"><\/b><\/h2><\/div>\n\n<p>The probationary license is subject to a three-year probationary period before the issuance of a full license. Thus, when&nbsp; the young driver is in one of the following situations&nbsp;, the driver&#8217;s license will be withdrawn for a minimum period of one month and the probationary period will be extended by one year:<\/p>\n<ul>\n<li>a speeding ticket of 21 to 25 km\/h outside the locality and if an administrative measure has already been imposed in the last two years;<\/li>\n<li>a blood alcohol test &gt; 0.1 \u2030 and if an administrative action has already been imposed within the last two years;<\/li>\n<li>speeding of 26 to 29 km\/h outside the locality combined with a minor violation of the LCR ;<\/li>\n<li>a blood alcohol test &gt; 0.1 \u2030 cumulative with a minor CSF violation;<\/li>\n<li>speeding over 30 km\/h outside the locality;<\/li>\n<li>driving with a suspended license;<\/li>\n<li>hit and run;<\/li>\n<\/ul>\n<p><strong>If a second violation is found during the probationary period, the probationary license is cancelled.<\/strong><\/p>\n<p>This means that the young driver will have to reapply for his driving license, but at the earliest one year after the offence and only if a psychological expertise attests to his ability to drive.<\/p>\n<p>If the training day has already been completed, the young driver will also have to repeat it.
